There has to be intent for it to be illegal (such as deliberately under declaring your profits). A tax avoidance scheme which is incorrectly administered does not automatically become evasion and therefore does not become illegal. The proof of this is whether or not there is criminal repercussions for the perpetrator. In the case of incorrectly administered EBTs there is only interest and late payment penalties.The Rangers EBT scheme is therefore not illegal and is at worst an incorrectly handled case of legal avoidance.
