Spot on mate. Hmrc are unbelievably under resourced. They can't compete with tax advisory firms and can only really act retrospectively. It all comes down to interpretation and the arguments get quite petty. If the government was truly annoyed by tax avoidance they could make the legislation very strict. It's only the really aggressive/ popular ones they pursue. That's part of the reason why we got chased with the BTC.

Every professional services firm have tax consultancy departments who try to help companies avoid tax. They've all been criticised at some point.
