As this e-petition has received more than 10 000 signatures, the relevant Government department have provided the following response:

It is now in the public domain that HM Revenue & Customs (HMRC) is seeking leave to appeal the First Tier Tribunal decision that found in favour of Rangers FC.

In relation to Employee Benefit Trusts (EBTs) more generally, HMRC has increasingly seen EBTs being used as a way of avoiding Pay as You Earn (PAYE) tax and National Insurance contributions (NICs). HMRC will form a view based on the facts of the case. Where HMRC believes a company has used an EBT as a way of trying to avoid obligations to account for PAYE and NICs, HMRC will challenge the arrangement and seek to recover the unpaid PAYE and NICs.

In cases where a company does not accept HMRC's view that the EBT scheme does not work and PAYE and NICs are due, then it for the company to appeal HMRC's decision within the appropriate time limit, and effectively choose to progress matters to litigation.

HMRC is disappointed to have lost the First Tier Tribunal stage of the court process and, as stated, will seek permission to appeal the Tribunal decision. The decision was not unanimous and the diligence of HMRC investigators was acknowledged by the whole tribunal. HMRC is committed to tackling avoidance and it is right that HMRC challenges the type of avoidance seen in this case to prevent the loss of substantial amounts of tax and NICs.

We do not comment on speculation about breaches of confidentiality.

This e-petition will remain open to signatures until the published closing date and will be considered for debate by the Backbench Business Committee should it pass the 100 000 signature threshold.

We have to reach the 100,000 target or they will happily sweep this injustice away. Keep pushing this Bears. No Surrender!

its sad to think were gettin over 40 k at each home game and still only 37,000 have signed it the rst should be doing more about this i reckon also if you have signed it remember to go into your email and ok it can guarantee alot of people have not done this

There is Rangers fans out there who haven't signed this.. It makes me sick tbh

Persevere with it. No Surrender.

We have to carry on pushing this. The response indicates they'd happily sweep this out the way. We cannot allow them to do that. Our only chance is to reach that target.

They acted as if the verdict had been delivered, and it was their actions which led to the sale to Whyte, their actions which led to the bank's strictures, and their actions which led to the rejection of the CVA.

It appears they've learned zilch from the case, which is disappointing.

This is one for Govan Bears. The only way to enforce questions on this is via your MP, who iirc is Ian Davidson (Labour). He is obliged to ask on your behalf should you request him to; that is his job. Even harder to avoid doing so if he gets 1,000 emails asking him. Probably one for a Govan RSC to get organised via members and their families.

The same RST who are fleecing Rangers fans for a part-share of a certificate without your name on it, and a £10 annual fee for the privelidge of being mugged off?

Aye, they should be doing more about this............

Sorry guys but can't see this getting to 100,000 signatures. Think it's time we got our arses down to our mp's & msp's. Not sure I'll have much luck with mine, Michael Mathieson, he's the dick that went along with the complaint made about the hokey cokey. What you have to remember is hmrc is a government department, so they are open to examination by the public as we pay their wages. Anyone thought of writing a smart arsed message asking, (under the freedom of information act) how the info about Rangers was leaked to the media?

The club need to push this. We have more at Ibrox on a Sat then have signed this.

This is a Fan initiative, the club can't get involved with HMRC still having the option to appeal. We as Fans should be more than able to get us to that target.

This is just one of the things in this saga that mystifies me. HMRC are surely appealing against the Holding Company that once ran Rangers FC. That company no longer exists. It was forced into liquidation by HMRC, who refused to accept a CVA.

Why are HMRC pursuing a company that no longer exists, and can't pay them a penny? Is it in the hope that the former holding company, wins the case against Collyer Bristow?

It can't be because it would set a precedent, because HMRC have won and lost cases involving EBT's.

On a serious note, thats the same wording of the press release they put out after the result was given. If they are still seeking permission to appeal and havent actually appealed yet, they must be struggling...

Why doesn't admin email every user on this site and tell them to sign it twice

This has been highly publicised on RM. I'd think(hope) on here we have all done our bit towards this, considering we are all at least semi-computer literate. This is about moving it to a wider audience outside RM and outside the confines of the internet. Any and all ideas welcome...

As there is no indication in the notice, specifically, which relevant Government Department provided the response?

Furthermore, by the use of the word ‘increasingly’, the following sentence of this response implies that there was never any positive opinion never mind a defined tax regulation relative to the use of EBTs as being eligible for Income Tax by HMRC.
