  1. This I think is the only real defence for Whyte. Few people buy clubs with their own money so Whytes no different than the rest. But if you're out for a quick buck then buying any football team never mind one thats facing a masssive tax bill is the last thing you'd do. And what if someone comes a long and makes an offer for the club, could the administrators accept it even if its not enough to pay off Whyte? Would Whyte be forced to accept it?

  11. Its a fuckin minefield. With the EBT thing we could at least claim ignorance. I know HMRC, and when it comes to VAT or Employers tax and NIC they will pursue you til the end of time because it is tax that has already been paid for by customers or employees. I've known of cases where people are due to pay VAT but are also due tax refunds because they have suffered CIS deductions, but the contractor hasn't paid the CIS deductions over to HMRC. HMRC will still pursue the VAT because it has already been paid for by the consumer. Decent people go bust and lose their businesses because of this.
  12. He's not giving £9 million away. The £9 million is money that has been deducted from employees wages and not passed over to HMRC. This is technically more serious than the whole EBT thing. Its one thing for HMRC to go after money that was never deducted from anyone, but this is the tax and nic that employees have had deducted out their wages. I really think we're fucked. And no i'm not a tim. HMRC will show no mercy on this.
  13. This simply isn't true. Rangers thought they were exploiting a legal loophole but they got it wrong, therefore not avoidance. No one has ever been penalised for tax avoidance, it is by definition impossible.
  14. Know how you feel, tax is taxing. My understanding is that we simply went about it wrong, we thought it was an avoidance scheme that was legal but we fucked up and it turns out it was illegal therefore not avoidance. I'm going to give up now because i'm beginning to act like a fuckin tim
  15. Never said they would. The evasion was carried out by a LTD company which is a legal entity in its own right. Unless their was any financial gain by those running the scheme then there wouldn't be any criminal prosecution against employees. Players wouldn't be touched, the onus is on the employer to operate the PAYE system. If Rangers didn't then its plain evasion. No one has ever been done for avoidance. Avoidance schemes have been closed down or challenged in court and deemed illegal, but never penalised or prosecuted.
  16. You can't be found guilty of avoidance. It is not retrospective. The government can close loopholes, if you then continue with the scheme after legislation then it is evasion.
  17. Avoidance is legal. What Rangers were doing wasn't avoidance it was evasion assuming the tribunal finds in favour of HMRC. If it was avoidance then we would be in the clear. Avoidance is when you essentially act within the letter of the law but not in the way Parliament originally intended: spirit of the law.
