Can we appeal this? who oversees hrmc? who made the decision? why? so many feckin questions.why not accept 9p in the pound? 2p was acceptable with pompey.how? why?

Except it wasn't.HMRC rejected this offer of 20p itp in June 2010.

Their current CVA the 2p itp one you mention hasn't been voted on and it is believed HMRC will reject.

Yes.

Might've took sometime but it happened.

Im not sayin it didnt happen, im just pointin out is wasnt as simple as it appears, they werent fiorentina for almost a full season,.and SA&SB failed to recognise them.

Was their situation the same as ours ???? When you go to their website all their honours are still listed there. Might be a silly question but who or what governing body can officially say whether or not all previous records of silverware and achievements stay with the Newco ?

Leeds had a CVA approved however HMRC appealed it. Eventually the assets were sold to Ken Bates and the old company was liquidated. Leeds United AFC became Leeds United FC (2007) or something similar. They recieved a 15pt penalty as exiting via a CVA is the approved method in England and by becoming a newco breached this.

Pre 1994 the beggars were called the Ceptic football and athletic club. Now they are just Ceptic football club. They kept their history of bheasting weans etc. Our club and history will be intact. The business side of things starts again. We will be back. Will take a few years possibly 4/5 but we will be back. And back stronger than ever. Don't listen to the bheasts who are desperate for us to have titles stripped so that they can get near us. Ain't gona happen. Stick with it lads. Super ally needs us now more than ever. Watp.

All the asets changed hands and it's a newco in every sense but i think it was one company buying the football club and the other going through a cva and then liquidating.

They never got to execute the CVA because of HMRC. That is why the were liquidated.

The Leeds situation was exactly the same situation as ours. They had their CVA rejected by HMRC and were forced to go into liquidation. Bates then bought all of the assets back (then sold them on to off shore accounts in his name too, but thats another story) and set about acquiring the 'Golden share' to allow them to compete in League 1.

This is where the similarities end though...

The media did not report the story negatively and it all happened so quickly that nobody really knew what to make of it.

The rival teams in League 1 were eventually called together by the Football League and voted that Leeds should be allowed into the league as long as they started on -15 points for that season. Leeds went on a great run, coming back from -15 and just missed out on promotion as they were beaten at Wembley by Doncaster.

BUT

Because of how this has been picked up by our Mhedia in Scotland and because we are still a top flight club and everyone seems to want to kick us while we are down I fear that we will end up with far more severe penalties from the other sides in the SPL.

I still feel physically sick.

This says the cva went through with 75.2% acceptance :disappointment:

Yes.

Yes.

Might've took sometime but it happened.

Italian law made that one a slow process. Scots law (which in this regard is almost identical to English & Welsh) if all assets are sold, that includes everything past and present.

Effectevly all that changes is our ban from Europe and SPL status. Some fans will take Div 3 though if given the chance. Me included.

I'll be happy to watch Aberdeen, Dundee and virtually any other SPL go through what we have.

Are people still discussing this? It's still the same club, the same history, the EXACT same. The only difference is there is a new company running us. Jesus fuck.

The same happened to Leeds, Fiorentina, check FC Servette in the swiss league, the exact same thing happened to them. It's still the same club, just another company that runs it.

The below notes are the official notes from KPMG who state that the CVA was rejected, so they did an asset sale for £1.7m to the NewCo.

Correct. HMRC were trying to block the asset sale I believe but dropped it
