Adoniram 1,919 Posted October 25, 2010 Share Posted October 25, 2010 i think there have been several cases when "sectarian" remarks have been construed differently by different judges.If i remember rightly, and i'll try and find the links, one guy was done for the sash. another rightly got away with it. so its not always as black and white as made out hereIntent,surroundings,incitement all influence a judges decision on whether to prosecute or not. (the guy walking down the street with me before a tims game was singing "aint no black in the Union Jack". I was arrested for it (honestly wasnt me as thats not my cup of tea. if it had been the billy boys then i would have admitted it)at court it was thrown out as when the 2 polic officers identified me, they were then asked if there were any blacks in the area (no excuse imo) when they said no, my lawyer asked for it to be thrown out as even though i had said i did not sing that song, who exactly was i offending if i did?? The judge agreed and threw it out.just to let you know, one of the cops who arrested me came around to the cell during the game and told me to GIRUY ya wee orange bastard, youre getting beat.
