Precedent doesn't work in Scottish Law as it does in American programmes, the whole of the incident is looked at and decided by a PF from there, very rarely if it all will you get a case that's completely similar to a previous one and even then the interpretation of the law is always key, how do you interpret what took place form the police report and in what manner did it take place?
