There is no criminal offence, that would be tax evasion. Tax avoidance is not an offence. If they win their appeal nobody will go to court far less prison. The HMRC case is not just against RFC but also MIH. If they win they get some money from MIH. They also get a legal precedent with which to use against other users of EBT schemes.
