EBTs are NOT ILLEGAL

HMRC are contesting the tax avoidance of the use of EBTs. There is no criminal offence, that would be tax evasion. Tax avoidance is not an offence. If they win their appeal nobody will go to court far less prison. The HMRC case is not just against RFC but also MIH. If they win they get some money from MIH. They also get a legal precedent with which to use against other users of EBT schemes.

They were not mate, we stopped using them when it was stopped. They were certainly not illegal at the time.

Unfortunately some chaps have absolutely no idea of the subject matter, I recollect several volunteering us into the firing line a week ago.........for something that has absolutely nothing to do with us, why these chaps witter on in that vein is beyond comprehension. :cgreen:

This is their final appeal, yes? If so, Rangers win 2-1 or 3-0 on tribunals. Constantly appealing till you get your way is daft. Imagine we kept holding the upcoming Scots referendum until one side got its way.

One more possible appeal route after this one I believe.

As I said in another thread, even though it has fuck all to do with us from a financial point of view, it does with regards to the principle of the matter as it is the name of Rangers which will once again be dragged through the mud.

I think English Law is based on precedent and so it would be worthwhile for them to get a 'positive' out come. It does seem a tad strange though that they're picking on a Scottish club as they have to go through Scottish Law, which is more based on justice, or at least ideas of fairness. I'd also say that as most politicians are lawyers themselves, they may think this is a good way of redistributing the country's wealth to their friends that are still in the profession?

Either way, it's a fuckfest.

It does have an effect.It effects the integrity of the clb,it will also affect every supporter that has to listen to the Mhanks

Even if HMRC appeal was to be successful this time, surely from the 'integrity' standpoint you make, the decision on the first two judgements has muddied the water on the whole business. It is clearly not a clear cut case of tax evasion, it is highly complex and technical matter that even the best legal minds in the country cannot agree on (assuming they win their appeal).

Maybe criticism should be more rightfully placed at the incompetents who managed to come up with such a contentious and complex piece of tax legislation in the first place.

How many more appeals until somebody looks at HMRC and asks what the fuck they are playing at?

How much have they spent on it so far? I bet it's enough to pay for the extra nurses NHS requires. Think that dickhead on radio Clyde will ask HMRC after he wrongly assumed we were guilty and questioned the nursing resources we prevented!

ROI were balloted for the euro as their currency and had a referendum every few weeks til they got the answer they wanted!. Look how that turned out.

Rangers 'big tax case' reopens as HMRC wins right to appeal

HER Majesty's Revenue and Customs have been granted leave to appeal the decision on the club's EBT payments to players and club staff.

RANGERS face another day in court following the announcement that the taxman has been granted leave to appeal the "big tax case" ruling.

On July 9 HM Revenue and Customs lost its original appeal against a tax tribunal ruling in favour of the Ibrox club and two days later announced that they would appeal the decision by a High Court judge.

That appeal has now been granted with an HMRC spokesperson today confirming: "HMRC continues to believe that schemes using Employee Benefit Trusts to avoid tax do not work. We have applied for permission to appeal the case to the Court of Session.

"Around 700 users of EBT schemes have already settled with us resulting in around £800m of tax and NICs being paid. We expect more to settle in the near future.

"These are avoidance schemes and we will continue to tackle those who do not pay up. It is not right that a small minority can avoid paying what they owe while the vast majority pay the right tax on their earnings. This case represents an important principle.

"HMRC is proud of our record of winning around 80% of cases that are taken to litigation by the taxpayer. We tackle avoidance wherever we see it and litigate where necessary to ensure schemes are defeated and the tax due is paid."

"The SPL presented no argument to challenge the decision of the majority of the Tax Tribunal and Mr McKenzie stated expressly that for all purposes of this Commission’s Inquiry and Determination the SPL accepted that decision as it stood, without regard to any possible appeal by HMRC."

i've said this previously, hmrc were never going to drop this witch hunt against us as want to make an example of a football club (just not an english one). looking back (big tin hat on) taking the 3 year hit was probably a wise move as we are now clear of that shit, Can you imagine how much 'interest and penalties' they would be looking for now. They'd be trying to fleece us for about a 100 million or so (worse than wonga).

There would be a noose around our heads for years and absolutely no investment in the team, money being hoarded in case of a wrong verdict and most likely general mediocrity.

Not saying murray, white, spl, sfa, other clubs, fans, media etc are not culpable but when all is said and done we're still the same club and will come out the other side stronger for all the shite we've had to put up with .

It's one way to look at it and it has a great deal of logic.

That said, the main hit was losing out on Europe for three years, and I'd rather not be in the top tier than remain there as a castrated oppressed ghost of a club, for everyone to bitch slap.

Nonetheless, the fact they wanted us to remain there as pawns for their fantasies or be kicked out remains a huge moral stain on the organisations involved and their ever so willing foot soldiers of hate.

HMRC were NEVER going to let this go. They needed to set a precedent and they chose(or had us chosen for them) us as the easiest most vulnerable target to go after. With all the money they have spent pursuing us so far and failing, they have no other option but to go to the bitter end and that means ultimately the House of Lords. This saga will go on 'till then using taxpayers money and NO ONE including The Daily Record, Radio Snyde, Alex Thompson will raise any voices of dissent regarding the amounts of public money being misused to pursue Oldco only to set a precedent that they cannot win.

Even more galling that we couldn't muster 100K signatures on the HMRC petition. Reminds me of the graffiti in a well-known Glasgow hostelry which read "APATHY RULES", underneath some jolly jokester penned "WHO CARES".

Just about sums up much of the Rangers support these days.

Simple answer. Vote "Yes" and the House of Lords in England will have no jurisdiction. Only joking, by the way. United we stand - divided we fall.

Do you really think we would get any better treatment in wee jacobite scotland? If you do just look at the way the bastards at the sfa have went for our jugular every chance they have had
